Terms and conditions

1. Provider and scope

These terms apply to the use of the AKKON platform (akkon.ai) and to the digital services of G O L B A N AG, Bahnhofstrasse 57, 9320 Arbon, Switzerland (hereinafter “AKKON”). AKKON.ai is a business unit of G O L B A N AG. The terms are addressed to companies, founders and private individuals with a business project in Germany, Austria and Switzerland.

2. Services

AKKON is a digital platform for the analysis, planning, automation and management of projects and companies. The scope depends on the plan booked (AKKON Idea, Founding, Start-up, Company, Company Plus) and on the work areas activated at the time of booking. AKKON is being activated step by step; an area is only offered once it is usable and tested.

Results from AKKON are produced with the help of artificial intelligence. They are a basis for decisions, with sources and assumptions marked. AKKON does not provide legal, tax or investment advice and does not give any guarantee of success. Decisions are made by the customer.

AKKON only carries out financial, legal, personal-data and external actions after approval by the customer and within the defined budgets and permissions. Every approval and every action is logged.

3. Conclusion of contract

The early access request is free of charge and non-binding. A contract for a plan is concluded when the plan is booked in the platform and AKKON confirms it by email. Billing only begins once the booked area has been activated.

4. Prices and payment

AKKON Idea 99, AKKON Founding 299, AKKON Start-up 699, AKKON Company 1'490, AKKON Company Plus 2'990 – in each case per month, in euros (Germany, Austria) or Swiss francs (Switzerland), plus statutory VAT.

Payment is made monthly in advance by card, SEPA direct debit or TWINT. For annual payment in advance, 10 monthly amounts are charged for 12 months.

AKKON + WERKFORM Review costs from 299 EUR or CHF per reviewed result. The price is shown before every review and only becomes payable upon confirmation by the customer. There are no hidden costs.

5. Obligations of customers

Information and uploaded documents must be true and may be used; third-party rights must be respected. Results from AKKON must be checked before they are used. Login credentials must be treated confidentially. Approvals may only be given by authorised persons.

6. Rights to data and results

The customer retains all rights to their own data and documents and receives the results for free use within their own company. Customers can export their own data at any time. AKKON does not use customer data to train AI models.

7. Collaboration with WERKFORM

Custom development is carried out by WERKFORM.ai on the basis of a separate contract. Data is only handed over to WERKFORM after a visible handover step in which the service, price and time frame, contracting party and scope of the data are displayed, and with the consent of the customer.

8. Term, termination, deletion

Plans with monthly payment can be cancelled at any time to the end of the current month, in the platform or by email to hallo@akkon.ai. Plans with annual payment end when the paid year expires, unless they are renewed. After the end of the contract, customers can export their own data for 30 days; the data is then deleted unless there is a statutory retention obligation. AKKON may block an account in the event of misuse.

9. Right of withdrawal for consumers in the EU

Anyone who lives in Germany or Austria and books a plan as a consumer may withdraw from the contract within 14 days of the conclusion of the contract without giving reasons. The withdrawal must be declared by email to hallo@akkon.ai or by letter to G O L B A N AG, Bahnhofstrasse 57, 9320 Arbon, Switzerland; sending it within the deadline is sufficient. Payments already made will be refunded within 14 days. If the customer expressly requests that AKKON begin providing the service before the withdrawal period expires, the value of the service provided up to the time of withdrawal must be paid on a pro rata basis. Companies and customers in Switzerland have no statutory right of withdrawal.

10. Liability

AKKON is only liable for damage in cases of intent or gross negligence. AKKON is not liable for decisions made by the customer, for the consequences of incorrect or incomplete information or for the use of results that have not been checked. Mandatory liability provisions, in particular for personal injury, and mandatory consumer rights in Germany and Austria remain unaffected.

11. Privacy

The processing of personal data is governed by the privacy policy.

12. Applicable law, place of jurisdiction, amendments

Swiss law applies. The place of jurisdiction is Arbon, Switzerland. For consumers in Germany and Austria, the mandatory provisions of the law of their country of residence and the places of jurisdiction there remain unaffected. AKKON may amend these terms; the version published on this page applies. For ongoing contracts, changes will be announced by email 30 days in advance.
